1. About these terms

These Terms of Use ("Terms") govern your access to and use of Comma App ("Comma", "we", "us", "our"), operated by [YOUR NAME] trading as Comma App (ABN [YOUR ABN]), Melbourne, Victoria, Australia.

By accessing or using Comma — including the website at getcomma.com.au and the application at app.getcomma.com.au — you agree to these Terms. If you don't agree, please don't use Comma.

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of Victorian courts.

2. What Comma is — and isn't

Comma is a personal finance dashboard tool. It helps you organise, visualise, and understand your own financial data by reading CSV files you export from your bank or financial institution.

Comma is not a financial product. Nothing in Comma — including charts, projections, AI-generated insights, tax modelling, or any other output — constitutes financial advice, investment advice, tax advice, or accounting advice. All information is for personal organisational purposes only. You should consult a qualified financial adviser, accountant, or tax professional before making financial decisions.

Comma is not an authorised deposit-taking institution, a financial services licensee, or a credit provider. We do not hold, move, or have access to your money.

3. Your account and licence

Free tier — available to anyone without an account. Data is stored in your browser only. No licence agreement is required beyond these Terms.

Pro and Lifetime licences — upon purchase, you are granted a non-exclusive, non-transferable, personal licence to use Comma's Pro or Lifetime features. This licence is for individual use only and may not be shared, resold, or transferred to another person.

You are responsible for maintaining the security of your account credentials and encryption password. You must notify us promptly at hello@getcomma.com.au if you suspect unauthorised access to your account.

Password warning: Your encryption password cannot be recovered by us under any circumstances. If you lose your password, your encrypted data is permanently inaccessible. We strongly recommend storing your password in a reputable password manager such as Bitwarden or 1Password. Loss of your password is not grounds for a refund after the 30-day guarantee period has elapsed.

4. Payments, refunds, and the 30-day guarantee

All purchases are processed by Lemon Squeezy as Merchant of Record. Prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Lemon Squeezy's terms and privacy policy apply to the payment transaction itself.

30-day money-back guarantee — if you are unsatisfied with Comma for any reason, email us at hello@getcomma.com.au within 30 days of purchase and we will issue a full refund. No questions asked.

After 30 days, all purchases are final. Pro and Lifetime licences include all future updates to the product at no additional cost.

Your rights under the Australian Consumer Law are not excluded or limited by these Terms.

5. Acceptable use

You agree not to use Comma to:

Comma's core application code is open source. You are welcome to inspect, fork, and self-host it subject to the licence terms in the repository. Commercial use of the Comma brand or resale of the service is not permitted without our written consent.

6. Intellectual property

The Comma name, logo, and brand elements are the property of Comma App. The application source code is open source — refer to the repository for the applicable licence.

Your financial data remains entirely your own. We claim no ownership over any data you upload or generate within Comma.

7. Disclaimer of warranties

Comma is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

You use Comma at your own risk. Always verify important financial figures against your official bank statements and consult a professional for financial decisions.

8. Limitation of liability

To the maximum extent permitted by Australian law, Comma App and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, financial loss, or loss of profit — arising from your use of or inability to use Comma.

Our total liability to you for any claim arising from these Terms or your use of Comma shall not exceed the amount you paid for your licence in the 12 months prior to the claim.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

9. Service availability and changes

We may modify, suspend, or discontinue any part of Comma at any time. We'll do our best to provide advance notice for significant changes.

Because Comma is a static web application, the app continues to function offline for Free tier users even if our servers become unavailable. Pro sync features require server availability.

In the unlikely event that Comma is discontinued, we will provide at least 90 days' notice to account holders and offer a pro-rated refund for Lifetime licences purchased within the prior 12 months.

10. Changes to these terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. For material changes, we'll notify account holders by email at least 14 days before the changes take effect. Continued use of Comma after changes take effect constitutes your acceptance of the updated Terms.
